These Terms & Conditions (the “Terms”) govern your access to and use of the Lumolands websites, the Lumobox device, any companion app(s), and related services (collectively, the “Services”). The Services are provided by Lumo Land Inc. (“Lumolands,” “we,” “our,” or “us”).

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Your use of the Services is also subject to the following policies, which are incorporated into these Terms by reference:

If there is a conflict between these Terms and a related policy, these Terms control unless the policy states otherwise.

2) Eligibility and accounts

You must be at least the age of majority in your jurisdiction to purchase products from us. If you are not, a parent or legal guardian must purchase and supervise use.

If you create an account, you agree to provide accurate information and keep your credentials secure. You are responsible for activities under your account.

3) Purchases, pricing, and taxes

All prices are shown at checkout in USD ($) and may change at any time. You are responsible for applicable taxes and fees unless stated otherwise.

We may use third-party payment processors. We do not store full payment card numbers. Your payment is subject to the payment provider’s terms and privacy practices.

4) Shipping, returns, and warranty

Shipping timelines, return rules, and warranty coverage are described in Delivery & Returns (delivery-and-returns.md).

We may refuse returns that do not meet eligibility requirements, or where fraud or abuse is suspected, as permitted by law.

5) Acceptable use

You agree not to misuse the Services or help anyone else do so. For example, you will not:

  • attempt to access systems or accounts you are not authorized to access,

  • interfere with the normal operation of the Services (including introducing malware),

  • reverse engineer, decompile, or attempt to extract source code from any software except where prohibited by law,

  • use the Services to create or distribute unlawful, harmful, or infringing content.

6) User content and creations

The Services may allow you to submit prompts, text, or other inputs, and may generate outputs (together, “User Content”).

  • Your responsibility: You are responsible for your User Content and for ensuring it does not violate law or others’ rights.

  • License to operate the Services: You grant Lumolands a limited, non-exclusive license to host, process, and display your User Content solely to provide, maintain, and improve the Services, and to enforce these Terms, subject to the Privacy Policy.

7) Intellectual property

The Services (including software, designs, trademarks, and content we provide) are owned by Lumolands or its licensors and are protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or lease any part of the Services.

Lumolands and Lumobox are trademarks of Lumo Land Inc.. All other marks belong to their respective owners.

8) Third-party services

The Services may integrate with or link to third-party websites or services. We do not control those third parties and are not responsible for their content, policies, or practices.

9) Disclaimers

To the maximum extent permitted by law, the Services and products are provided “AS IS” and “AS AVAILABLE.” We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Services will be uninterrupted, error-free, or that generated outputs will be accurate or meet your expectations.

10) Limitation of liability

To the maximum extent permitted by law, Lumolands will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data.

Our total liability for any claim related to the Services will not exceed the greater of (a) $100 or (b) the amounts you paid to us for the Services in the 12 months before the event giving rise to the claim, unless a different limit is required by law.

Some jurisdictions do not allow certain limitations; in those jurisdictions, these limitations apply to the fullest extent permitted.

11) Indemnification

You agree to indemnify and hold harmless Lumolands and its affiliates, officers, directors, employees, and agents from claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your User Content, or your violation of these Terms.

12) Dispute resolution; binding arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be settled by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. The arbitration will take place on an individual basis; class arbitrations and class actions are not permitted.

You and Lumolands agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

13) Governing law

These Terms and any disputes arising under them are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles, except to the extent preempted by federal law.

14) Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms and update the effective date. Continued use of the Services after changes become effective means you accept the updated Terms.
